Trekeffect Incorporated doing business as Mirin ("Company," "we," "us," or "our") hosts websites that our customers build. We respect the rights of people who create things, and we expect our customers to do the same.

This Policy explains how to tell us that a website hosted on Mirin uses your work without permission, and what we do when you tell us. It follows the Digital Millennium Copyright Act, 17 U.S.C. § 512, and should be read alongside our Terms of Service.

To report a website for another reason, such as a scam or a page pretending to be another business, use the report form.

1Reporting Copyright Infringement

If you believe a website hosted on Mirin copies your work, send our copyright agent a written notice that includes all of the following:

  • Your physical or electronic signature, or that of a person authorized to act for the copyright owner
  • The copyrighted work you say was copied. If there are several, a representative list is enough
  • The material you want removed and where it is, with the full web address of each page
  • Your name, mailing address, telephone number, and email address if you have one
  • A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act for the owner

A notice that leaves out any of these may not be one we can act on. If it tells us the work, the material and how to reach you, we will contact you for what is missing.

2Where to Send a Notice

Send the notice to our designated copyright agent. Email reaches us fastest.

3What Happens Next

When we receive a notice that includes everything in Section 1, we promptly:

  • Remove the material or take the page offline
  • Tell the customer whose website it is, and give them a copy of the notice, including your name and contact details
  • Keep a record of the notice

We do not decide who owns a work. We act on notices that meet the law's requirements and leave disputes about ownership to the people involved and, if needed, to a court.

4If Your Content Was Removed

If we removed material from your website and you believe that was a mistake or that the material was wrongly identified, you may send our copyright agent a counter notice that includes all of the following:

  • Your physical or electronic signature
  • The material that was removed and where it appeared before it was removed
  • A statement, under penalty of perjury, that you believe in good faith the material was removed by mistake or misidentification
  • Your name, mailing address, and telephone number
  • A statement that you consent to the jurisdiction of the federal district court for the district where your address is located, or, if your address is outside the United States, for any district in which we may be found, and that you will accept service of process from the person who sent the original notice or that person's agent

We send a copy of a complete counter notice to the person who sent the original notice and tell them the material will be put back in 10 business days. We put it back 10 to 14 business days after we receive the counter notice, unless that person first tells our copyright agent that they have filed a court action to stop the use.

Nothing in this Policy limits our right to remove content or close an account under our Terms of Service.

5Repeat Infringers

We end the accounts of customers who infringe copyright repeatedly, in appropriate circumstances. We may also limit or end an account after a single serious infringement.

6False Claims

The law makes a person who knowingly misrepresents that material is infringing, or that it was removed by mistake, liable for the damages that causes, including costs and attorneys' fees. If you are not sure whether something infringes your rights, consider speaking with a lawyer before you send a notice.
